The website at opencommo.com and its related application (together, the "Service") are operated by OpenCommo ("we", "us", or "our"). By using the Service, you agree to these Terms for yourself or the entity you represent and confirm that you are at least 18.
1. Accounts
Provide accurate account information and keep your credentials confidential. You are responsible for activity under your account. Report unauthorized use to hello@opencommo.com.
2. Acceptable use
You may not use the Service to violate applicable law or third-party rights; attack, disrupt, reverse engineer, or gain unauthorized access to the Service; build a competing product from our outputs; or submit unlawful, harmful, or infringing content. We may suspend accounts that violate these Terms or create a security or billing risk.
3. Service terms
Available plans and allowances are described in the application. We may apply reasonable controls to protect the Service. We do not guarantee uninterrupted availability. The Service is for operational support and must not be the sole control for high-risk decisions.
4. Fees and payment
Paid plans are billed through our payment processor. Fees are non-refundable except where required by law. We will provide at least 30 days' notice of price changes, which take effect at the next renewal.
5. Intellectual property
We retain all rights in the Service, including its software, models, documentation, and content. You retain rights in data you submit. You may not copy, resell, or sublicense the Service unless expressly permitted.
6. Feedback and confidentiality
Feedback may be used without restriction or attribution. Non-public information we designate as confidential may be used only to exercise rights under these Terms and must not be disclosed to third parties.
7. Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ACCURATE OR THAT THE SERVICE IS ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR LOST PROFITS. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate the Service for material breach or where required by law.
10. Governing law and changes
These Terms are governed by the laws of [Governing law — state / country]. Disputes will be heard in France. We will give at least 30 days' notice of material changes.
